• 1. Service Description
• 1.1. The ZEST platform enables customers to set up and configure cloud servers for use as mail and VPN servers.
• 2. Account Creation and Usage
• 2.1. To access the ZEST platform, you must create an account by providing accurate and complete information.
• 2.2. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
• 2.3. You agree not to use the ZEST platform for any illegal, unauthorized, or unethical purposes.
• 3. Payment and Billing
• 3.1. The server service is available as a monthly or yearly subscription.
• 3.2. Customers are required to provide valid payment information and authorize the Company to charge the applicable fees for using the ZEST platform.
• 3.3. Fees and payment terms are outlined on the checkout page and are subject to change at the Company&aposs discretion. Any changes will be communicated in advance.
• 3.4. For subscriptions with paid domains, the full subscription amount is collected on the 11th month for annual subscriptions.
• 3.5. If the subscription doesn&apost include a paid domain, recurring payments for annual subscriptions will be collected exactly on the 1-year anniversary, and recurring payments for monthly subscriptions will be collected exactly on the 1-month anniversary.
• 4. Data Privacy and Security
• 4.1. The Company will take reasonable measures to protect the privacy and security of customer data stored on the ZEST platform.
• 4.2. By using the ZEST platform, you acknowledge and agree that the Company may collect and use certain information as outlined in our Privacy Policy.
• 4.3. The Company will not be liable for any loss or unauthorized access to customer data caused by factors beyond its control.
• 5. Intellectual Property
• 5.1. All intellectual property rights associated with the ZEST platform and its content are owned by the Company or its licensors.
• 5.2. You may not reproduce, distribute, modify, or create derivative works of any content from the ZEST platform without prior written consent from the Company.
• 6. Limitation of Liability
• 6.1. The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to the use or inability to use the ZEST platform.
• 7. Illegal Use and Illicit Activities
• 7.1. The customer is solely responsible for the content and usage of the servers provided by the Company.
• 7.2. It is strictly forbidden to store, transmit, or share any illegal or illicit material on the servers. This includes, but is not limited to, content that infringes upon intellectual property rights, contains malicious software or malware, promotes hate speech, or violates any laws or regulations of the jurisdiction countries.
• 7.3. The Company reserves the right to monitor customer accounts and server usage to ensure compliance with applicable laws and regulations.
• 7.4. Any customer account associated with any illegal activities or illicit content, as determined by the Company, will be terminated immediately without refund.
• 8. Termination
• 8.1. Canceling Immediately: This method will permanently delete any server or backup solution associated with the subscription, but preserves the registered domains without renewing. These domains can be used again in a new subscription.
• 8.2. Opting Not to Renew: This option will preserve any paid services until the end of the subscription period. Domains will not be renewed if the subscription is canceled, and domain registration will be dropped.
• 9. Domain Transfer
• 9.1. After subscription cancellation, the customer is free to transfer the paid-for domain to any other registrar.
• 10. Jurisdiction
• 10.1. The usage of the servers and services provided by the Company is subject to the jurisdiction of the laws of the United States and the countries in which the data centers are located.
• 11. Governing Law
• 11.1. This Agreement shall be governed by and construed in accordance with the laws of United States.
• 12. Amendments
• 12.1. The Company reserves the right to update or modify these terms and conditions at any time. Any changes will be effective immediately upon posting the revised Agreement on the ZEST platform.
